TERMS & CONDITIONS.

Version 2026-09-16

These terms cover training risk, health responsibilities and liability. Have a solicitor review them before you take payments, so the release, liability and indemnity clauses hold up in New South Wales.

1. About these terms

Strong Ohana is operated by Mantleworks Pty Ltd (ABN 60 687 219 021) in New South Wales, Australia ("Strong Ohana", "we", "us", "our"). These terms form a binding agreement between you and us and apply whenever you access this website, join our waitlist, correspond with us about coaching, or use any part of the Strong Ohana app or coaching service (together, the "Service").

By submitting the waitlist form, creating an account, or otherwise using the Service, you confirm that you are at least 18 years of age, that you have read these terms in full, that you understand them, and that you accept them. If you do not accept them, do not use the Service.

We may amend these terms as the Service develops. The version date at the top of this page records the current version, and material changes will be flagged to you directly where we hold your contact details. Continuing to use the Service after a change takes effect means you accept the amended terms.

2. No medical advice — read this section carefully

Strong Ohana is a strength and conditioning coaching service. It is not a medical, physiotherapy, psychological, dietetic, or allied health service, and we are not your treating practitioners. Nothing on this website, in any program, in any coach message, video review, article, research summary, supplement discussion, product recommendation, email, or other material we provide is medical advice, diagnosis, treatment, or a substitute for advice from a qualified health professional who knows your history.

You must obtain clearance from your medical doctor before beginning, resuming, or materially changing any exercise program obtained through the Service, and you must continue to follow the advice of your treating practitioners in preference to anything we say. Clearance is particularly important, and you agree that you will obtain it, if any of the following apply to you: you are aged 40 or over and have not exercised regularly in the last 12 months; you have or suspect you have a cardiovascular, respiratory, metabolic, neurological, or musculoskeletal condition; you have high or unmanaged blood pressure, chest pain, dizziness or fainting episodes; you have osteoporosis, osteopenia, arthritis, a hernia, a prolapse, or a joint replacement; you are pregnant, postpartum, or trying to conceive; you have had surgery, a fracture, or a significant injury; you take prescription medication of any kind; or you have any other reason to believe that strenuous resistance training may not be safe for you.

You represent and warrant that you are medically able and physically fit to undertake the training you choose to perform, and that you will not perform any exercise your doctor has advised against. You must stop training immediately and seek prompt medical attention if you experience pain, chest discomfort, breathlessness, dizziness, faintness, numbness, nausea, an audible or felt joint or tissue injury, or any other symptom that concerns you. Do not wait for coach feedback before seeking care, and do not treat coach feedback as medical clearance to continue.

Any discussion of supplements, nutrition, sleep, recovery, or third-party products is general information only. It is not a prescription, does not take account of your circumstances, medications, allergies, or conditions, and must be discussed with your doctor or pharmacist before you act on it.

3. The waitlist

Joining the waitlist registers your interest. It is not an offer, a contract for coaching, a reservation, or a guarantee of a place, price, start date, program, coach, or service level. We may open, close, pause, reorder, or discontinue the waitlist at any time, and we may decline to offer coaching to any person at our discretion, including where we consider that we are not the appropriate provider for their health circumstances.

By joining, you consent to us sending you a confirmation email and occasional updates about the launch and other major Strong Ohana news. You can withdraw that consent at any time by replying to any email or contacting us using the details below, and we will remove you from the list.

The information you give us — including your country, state or region, post code, age range, lifting experience, and anything you choose to tell us about yourself — is used to understand who we are building for, to plan capacity by location, and to design programs and content. You agree that the information you provide is accurate and is your own, and that you will not submit another person's details without their authority. Do not send us detailed medical records or sensitive health information through the waitlist form.

4. Accounts and access

Coaching accounts are created for clients we have accepted. You are responsible for the accuracy of your account details, for keeping your password confidential, for all activity under your account, and for notifying us immediately if you suspect unauthorised access. You must not share your account, resell access, or use the Service on behalf of another person or business without our written consent.

You must tell your coach promptly and accurately about your injuries, symptoms, medical conditions, medications, and how training is affecting you. The Service depends on that information, and we are not responsible for outcomes arising from information you withhold or misstate.

5. Assumption of risk and release

You acknowledge and agree that resistance training, barbell training, conditioning, and related physical activity carry inherent and significant risks, even when programs are well designed and supervised. Those risks include muscle strains and tears, tendon and ligament injury, joint injury, disc and spinal injury, fractures, hernia, concussion, dropped or falling loads, equipment failure, aggravation of pre-existing conditions, heat illness, fainting, cardiac events, permanent disability, and death.

You voluntarily accept those risks. You agree to train within your own capacity, to use appropriate equipment and safety measures, to warm up and progress sensibly, to use spotters or safety devices where appropriate, to train in an environment that is safe and suitable, and to exercise your own judgement about whether to attempt any prescribed exercise, load, or session. You may decline or modify any prescription at any time, and you should do so whenever it does not feel safe.

To the maximum extent permitted by law, and except as set out in the consumer guarantees section below, you release Strong Ohana, Mantleworks Pty Ltd, and their directors, employees, coaches, and contractors from all claims arising from injury, loss, or damage suffered in connection with your participation in physical activity performed under or in reliance on the Service.

6. Remote and unsupervised training

Where coaching is delivered remotely, we are not present, we cannot see your technique in real time, and we cannot intervene. Video review is retrospective and limited by what the footage shows. You are solely responsible for supervising your own session, for the safety of your training environment and equipment, and for deciding whether to proceed with any exercise. If you require hands-on supervision for safety, you should train with a coach in person instead of using the Service.

7. No guarantee of results

Strength, body composition, health, and performance outcomes depend on genetics, age, health status, medication, sleep, nutrition, stress, consistency, technique, and factors outside anyone's control. We make no representation, warranty, or guarantee about any specific result or timeframe, and any example, testimonial, or case study describes one person's experience rather than what you should expect.

8. Content you submit

You retain ownership of the videos, logs, notes, and messages you submit. You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, and use that content for the purpose of delivering, reviewing, and improving your coaching, and for internal quality and training purposes. We will not use your content for marketing or publish it publicly without your prior written consent.

Form check videos are private between you and your coach by default. After a video has been reviewed you may keep it in your account, delete it, or choose to share it with the Strong Ohana community. Choosing to share is voluntary and specific to that video: it grants us permission to display that video, its exercise name, and your coach's review to other Strong Ohana members. You can withdraw sharing or delete the video at any time, although we cannot recall copies another person has already downloaded or captured. Deleting a video removes it from your account and from our storage.

You must not submit content that infringes another person's rights, that is unlawful, misleading, defamatory, harassing, or obscene, or that contains another person's personal or health information without their consent. We may remove content that breaches these terms.

9. Acceptable use

You must not misuse the Service, including by attempting to gain unauthorised access, probing or testing security, interfering with other users, scraping or bulk-extracting data, introducing malicious code, reverse engineering the app, or using the Service to provide a competing service or to coach third parties.

10. Intellectual property

The Strong Ohana name, marks, programs, exercise libraries, written and video materials, research summaries, and app content are owned by Mantleworks Pty Ltd or its licensors, except for content you submit. We grant you a personal, revocable, non-transferable licence to use that material for your own training while you hold an active account or waitlist registration. You must not copy, publish, redistribute, adapt, sell, or commercially exploit it without our written permission.

11. Third parties, products, and links

The Service relies on third-party infrastructure, payment, and communication providers, and may link to or endorse third-party products, supplements, equipment, or content. We are not responsible for third-party goods, services, advice, availability, outages, or acts and omissions, and any purchase you make from a third party is a contract between you and that third party on their terms. Some links may be affiliate links, meaning we may receive a commission at no additional cost to you; that does not change our obligation to be honest about what we recommend.

12. Fees, packs, and payment

Pack names, inclusions, and prices shown before launch are indicative and subject to change until confirmed at checkout. Where the Service is paid, the price, billing period, and cancellation arrangements presented at the time of purchase apply. Unless the law requires otherwise, or we say otherwise in writing, fees for periods already delivered are not refundable, and you may cancel future billing periods in accordance with the arrangements presented to you at purchase.

13. Privacy

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy explains what we collect, why we collect it, who we share it with, how long we keep it, and how to access, correct or delete it. It forms part of these terms. In short: we collect the information you give us and the information generated as you train, your health information and form check videos stay private between you and your coach unless you choose otherwise, we do not sell your information, and some records are retained where we are required or permitted by law to keep them.

14. Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If a statutory guarantee applies and cannot be excluded, but we are permitted to limit our liability for breach of it, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

15. Disclaimer

Subject to the section above, the Service and all information, programs, and content are provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, currency, uninterrupted availability, or non-infringement. Research summaries reflect our reading of published material at a point in time and may be incomplete or superseded.

16. Limitation of liability

Subject to the Australian Consumer Law section above, and to the maximum extent permitted by law, Strong Ohana, Mantleworks Pty Ltd, and their directors, employees, coaches, and contractors are not liable to you or any other person for any personal injury, illness, death, aggravation of a condition, loss of income, loss of profits, loss of data, loss of opportunity, or any indirect, incidental, special, punitive, or consequential loss arising out of or in connection with the Service, your training, your reliance on any information we provide, or any act or omission of a third party, whether the claim arises in contract, tort (including negligence), statute, or otherwise, and whether or not we were advised of the possibility of that loss.

To the maximum extent permitted by law, our total aggregate liability for all claims connected with the Service is limited to the greater of AUD $100 and the total fees you paid to us in the 12 months before the event giving rise to the claim. Where the waitlist is free, that means our aggregate liability in respect of the waitlist is limited to AUD $100.

Our liability is reduced to the extent that your loss is caused or contributed to by your own act or omission, including failing to obtain medical clearance, withholding or misstating health information, exceeding your capacity, ignoring pain or symptoms, training in an unsafe environment, or departing from your program.

17. Indemnity

You indemnify and will keep indemnified Strong Ohana, Mantleworks Pty Ltd, and their directors, employees, coaches, and contractors against all claims, liabilities, losses, damages, costs, and expenses (including reasonable legal costs) arising from or in connection with your breach of these terms, your misuse of the Service, your provision of inaccurate or incomplete health information, your training in an unsafe manner or environment, or any claim brought by a third party in connection with your use of the Service. This indemnity does not apply to the extent the loss is caused by our own negligence or wilful misconduct, or to the extent it cannot lawfully be imposed.

18. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access or waitlist registration, with or without notice, if you breach these terms, if we believe continued participation poses a risk to your health or another person's safety, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination — including the medical disclaimer, assumption of risk, limitation of liability, and indemnity — continue to apply after your access ends.

19. General

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales and courts hearing appeals from them. If any provision is found to be void, unenforceable, or illegal, it is severed and the remaining provisions continue in force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms without our consent; we may assign ours in connection with a sale or restructure of the business. These terms, together with any purchase terms presented to you, form the entire agreement between us about the Service.

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including outages, natural disasters, pandemics, industrial action, and government action.
